DMCA Copyright Policy

GQV.ai respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act of 1998 (DMCA) and will respond promptly to valid notices of alleged copyright infringement.

This policy explains:

  • How to report copyright infringement on our platform
  • How we respond to DMCA takedown notices
  • How to file a counter-notice if you believe content was wrongly removed
  • Our repeat infringer policy

3. Filing a DMCA Takedown Notice

If you believe that content on GQV.ai infringes your copyright, you may submit a DMCA takedown notice to our DMCA Agent.

3.1 Required Information

To be valid under the DMCA, your notice must include ALL of the following information:

  1. Identification of the copyrighted work:

    • Describe the copyrighted work you claim has been infringed
    • If multiple works are involved, provide a representative list

  2. Identification of the infringing material:

    • Provide the URL or specific location of the alleged infringing content on GQV.ai
    • Include enough detail for us to locate the content (e.g., username, character name, generation ID)

  3. Your contact information:

    • Full legal name
    • Mailing address
    • Telephone number
    • Email address

  4. Good faith statement:

    • Include the following statement: "I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."

  5. Accuracy statement and signature:

    • Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
    • Provide your physical or electronic signature

3.2 How to Submit

Subject Line: "DMCA Takedown Notice - [Brief Description]"

3.3 Incomplete Notices

Notices that do not include all required information may not be processed. We may contact you to request missing information.

3.4 False Claims Warning

⚠️ Warning: Filing a false or fraudulent DMCA notice may result in:

  • Legal liability for damages, costs, and attorney's fees under 17 U.S.C. § 512(f)
  • Criminal penalties for perjury

Only submit a DMCA notice if you are the copyright owner or authorized to act on their behalf.

4. Our Response to Valid DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  1. Acknowledge receipt within 24-48 hours
  2. Remove or disable access to the allegedly infringing content within 1-3 business days
  3. Notify the user who uploaded the content that it has been removed due to a DMCA complaint
  4. Provide the user with a copy of the DMCA notice (with your contact information included)
  5. Document the complaint for our repeat infringer policy

5. Filing a DMCA Counter-Notice

If you believe your content was removed by mistake or misidentification, you may file a counter-notice.

5.1 Required Information

Your counter-notice must include ALL of the following:

  1. Your contact information:

    • Full legal name
    • Mailing address
    • Telephone number
    • Email address
    • Username on GQV.ai

  2. Identification of removed content:

    • Description of the content that was removed
    • URL or location where the content appeared before removal

  3. Good faith statement:

    • "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."

  4. Consent to jurisdiction:

    • "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the District of Delaware if my address is outside the United States), and I will accept service of process from the person who filed the original DMCA notice or an agent of that person."

  5. Physical or electronic signature

5.2 How to Submit

Subject Line: "DMCA Counter-Notice - [Brief Description]"

5.3 Our Response to Counter-Notices

Upon receipt of a valid counter-notice:

  1. We will forward it to the original complainant within 2-3 business days
  2. We will wait 10-14 business days to see if the complainant files a lawsuit
  3. If no lawsuit is filed, we may restore the content after 10-14 business days
  4. If a lawsuit is filed, the content will remain removed until the court resolves the dispute

5.4 False Counter-Notice Warning

⚠️ Warning: Filing a false counter-notice may result in legal liability for damages, costs, and attorney's fees under 17 U.S.C. § 512(f).

6. Repeat Infringer Policy

6.1 Three-Strike Policy

We maintain a strict policy against copyright infringement. Users who repeatedly infringe copyrights will have their accounts terminated.

Our policy:

  • First violation: Warning and content removal
  • Second violation: Temporary account suspension (7-30 days) and content removal
  • Third violation: Permanent account termination and all content deletion

6.2 Immediate Termination

We reserve the right to immediately terminate accounts for egregious violations, including:

  • Systematic copyright infringement (uploading multiple copyrighted works)
  • Commercial-scale infringement (operating infringement as a business)
  • Ignoring DMCA warnings and continuing to infringe
  • Creating new accounts to evade previous infringement penalties

7. Limitations and Disclaimers

7.1 Not Legal Advice

This policy provides general information and does not constitute legal advice. If you have legal questions about copyright law or DMCA procedures, consult an attorney.

7.2 No Obligation to Monitor

We are not obligated to monitor content uploaded by users or to actively seek out copyright infringement. We respond to valid DMCA notices as required by law.

7.3 User Responsibility

Users are solely responsible for ensuring they have the legal right to use all content they upload, including:

  • Training images for AI characters
  • Reference images for content generation
  • Source videos for Motion Transfer features

8. Proactive Measures

While we rely primarily on DMCA notices, we also take proactive steps to prevent copyright infringement:

  • ✅ Clear copyright warnings in our Terms of Service and user interface
  • ✅ Educational resources about copyright and fair use
  • ✅ Reporting tools for users to flag potential infringement
  • ✅ Regular review of flagged content
  • ✅ Cooperation with copyright holders and industry organizations

9. Special Considerations for AI-Generated Content

9.1 Character Training Images

When you upload images to train an AI character (IMAGE_LORA):

  • You represent that you own or have rights to all training images
  • Using copyrighted images (e.g., photos of real individuals, movie screenshots) without permission may violate copyright law
  • We may remove characters trained on infringing content

9.2 Style Transfer and Motion Transfer

When using our Style Transfer or Motion Transfer features:

  • You must have rights to both the source image/video AND your character
  • Using copyrighted reference content (e.g., viral videos, professional photography) without permission may violate copyright law
  • "Viral content" and "trending content" are often protected by copyright

9.3 Fair Use

Some uses of copyrighted material may be protected by fair use under U.S. copyright law. However:

  • Fair use is determined on a case-by-case basis by courts
  • We cannot determine whether your use qualifies as fair use
  • You bear the risk if your fair use claim is rejected
  • We may still remove content upon receiving a valid DMCA notice, even if you believe it's fair use

10. International Users

10.1 Non-U.S. Copyright Laws

While this policy focuses on U.S. DMCA procedures, copyright laws exist worldwide:

  • European Union: Copyright Directive, Article 17 (formerly Article 13)
  • United Kingdom: Copyright, Designs and Patents Act 1988
  • China: Copyright Law of the People's Republic of China
  • Other countries: Various copyright and intellectual property laws

Users are responsible for complying with copyright laws in their jurisdiction.

10.2 Non-U.S. Takedown Requests

If you are a copyright owner outside the United States, you may still submit a DMCA-style notice to us. Please include:

  • All information required in Section 3.1
  • Reference to the applicable copyright law in your country
  • Evidence of your copyright ownership under your local law

11. Modifications to This Policy

We may update this DMCA policy to reflect changes in law or our practices. Material changes will be communicated through:

  • Update to the "Last Modified" date at the top of this policy
